GENERAL INFORMATION

This Privacy Policy is designed to inform you about our policies regarding the collection and use of personally identifiable information (“Personal Information”) from visitors to any OnCall Technical Services website (“Site”) and customers using services provided by OnCall Technical Services (Site visitors and Service users are “Users”).

By using the Site or Services, you acknowledge and agree to the terms and conditions contained in this Privacy Policy. If you do not agree to all of these terms and conditions, do not continue to visit the Site or use any of the Services.

INFORMATION COLLECTION

Personal Information

OnCall Technical Services only collects Personal Information, such as your name, address, age, telephone number, and e-mail address, that you voluntarily provide to us. You are not required to provide OnCall Technical Services with any such information, but you may be unable to use or access certain Services or portions of the Site if you do not provide any such information.

OnCall Technical Services may ask you to provide certain Personal Information when you purchase Services from OnCall Technical Services or when you register for events or contests. OnCall Technical Services also may ask you to provide Personal Information in other limited circumstances specified at the time the information is gathered.

Other Information

In addition to voluntarily given Personal Information, OnCall Technical Services collects Site activity information (through the use of “cookies”), IP addresses, demographic information and information supplied by third parties.

OnCall Technical Services’s Web server automatically creates log files for each Site User to allow OnCall Technical Services to monitor Site use and to make our site more useful to our visitors. The access logs do not contain personal information, but contain information relating to the details of a User’s Site visit, including the IP address of the visitor, the date and time of use, the path taken through the Site, files reviewed and downloaded, and errors encountered.

OnCall Technical Services may collect non-Personal Information that is not capable of specifically identifying an individual such as zip codes, ages and income levels. OnCall Technical Services uses such information to improve the Site and Services and better target its Users’ needs and preferences.

Third Party Information

OnCall Technical Services may receive Personal and non-Personal Information from third parties. The use of this information shall not be restricted by this Privacy Policy.

Cookies

OnCall Technical Services also uses ‘cookies’. A cookie is a piece of data that can be written to a User’s hard drive when the User visits our Site. These cookies are activity recordation files that store information on a User’s Site visits and preferences. OnCall Technical Services does not, for example, scan a User’s hard drive for other information not located in the cookie.

OnCall Technical Services tracks a User’s activities by cookies in order to offer features that would not be possible without them and to recall information regarding the User and his or her preferences during subsequent Site visits. You may disable cookies in your browser’s preferences, although you may no longer be able to access certain Site features, including interactive features. Other companies’ uses of cookies are covered by their own privacy policies. OnCall Technical Services is not liable or otherwise responsible for third party cookies or damage caused thereby.

USE OF INFORMATION

OnCall Technical Services uses collected Personal Information to perform Services, customize and optimize the Site, and for other internal purposes, such as sending information to the User about the User’s account, OnCall Technical Services’s Services, and advertisements for products and services that may be of interest to User (these and any other communications using Personal Information are “Notices”).

Except as otherwise expressly stated herein, OnCall Technical Services will use and disclose your information for its own internal business purposes, which include responding to User e-mails, fulfillment of product and service orders, sending communications to Users, including marketing and promotional communications, and other general OnCall Technical Services operations.

Personal Information collected by OnCall Technical Services is not provided to unaffiliated third parties, except when the User specifically consents to such distribution or when OnCall Technical Services discloses information to third parties as provided under “Exceptions” below.

This policy covers only information that is collected specifically and solely by OnCall Technical Services. Any information that you disclose when participating in newsgroups or other public internet forums becomes public. Moreover, by participating in newsgroups, your e-mail address may become available to any third parties accessing our Web site and as a result, you may receive unsolicited e-mail from such third parties.

If you do not want your Personal Information to be collected or used for any of these purposes, you may “opt out” by following the process described below. Please note that opting out may limit or terminate your access to portions of the Site, the Services, or other functions provided by OnCall Technical Services.

EXCEPTIONS TO USE OF INFORMATION

NOTWITHSTANDING ANY RESTRICTIONS OTHERWISE STATED HEREIN, ONCALL TECHNICAL SERVICES MAY DISCLOSE USERS’ PERSONAL AND NON-PERSONAL INFORMATION IN THE FOLLOWING CIRCUMSTANCES:

  1. If OnCall Technical Services believes in its sole discretion that disclosing this information is necessary or reasonable to enforce the terms and conditions of our Site or Services or OnCall Technical Services rights in connection with the Site, Services, or User;
  2. If OnCall Technical Services reasonably believes that applicable law, or order requires the disclosure;
  3. To third parties who provide services to OnCall Technical Services enabling OnCall Technical Services to operate the Site or provide Services to the User if that such third parties agree to use and disclose the information shared in accordance with the terms of this Privacy Policy; or
  4. As part of negotiations and due diligence for, and as part of, the sale of our business or any of its assets.

SECURITY

OnCall Technical Services has undertaken what it believes are reasonable security policies and procedures to secure the information we collect online. We do not collect or store credit card information within the OnCall Technical Services website. Credit card information requested by OnCall Technical Services is protected by 128-bit encryption and Secure Sockets Layer (SSL) security features.

Certain User functions are password-protected. User should not give his or her password to any third party or otherwise allow the password to become known (by not logging out after ending a session, for example). Despite its efforts to maintain security and confidentiality for information, OnCall Technical Services does not warrant or otherwise promise that there will be no unauthorized access to, use or disclosure of User information, including Personal Information.

CHILDREN

The Site and OnCall Technical Services’s Services are not intended for use by children, and OnCall Technical Services does not knowingly collect any Personal Information from children under 13. If you are under age 13, you may not submit or post any information or material on the Site or otherwise provide such information to OnCall Technical Services, including but not limited to Personal Information.

Unless otherwise specified, you must be at least 18 years old in order to participate in any online contests or other Site events or functions.

OnCall Technical Services encourages parents to monitor the websites that their children visit. OnCall Technical Services relies in part on parents to prevent unauthorized access to the Site and the Services, and to comply with the provisions of this statement.

CORRECTIONS, UPDATED INFORMATION, OPTING-OUT, OR QUESTIONS

CHANGES TO POLICY

OnCall Technical Services may change this policy at any time at its sole discretion. Use of the OnCall Technical Services Web site constitutes consent to any policy then in effect.

MISCELLANEOUS

Governing Law.

This Privacy Policy is governed by and interpreted, construed and enforced in accordance with the laws of the state of Minnesota, except for its conflict of laws provisions and principles of comity. Any action arising out of or relating to this Privacy Policy will be exclusively venued in a state or federal court situated within the State of Minnesota. User irrevocably consents and submits to the personal jurisdiction of said courts for all such purposes.

Entire Agreement.

This Privacy Policy contains the entire agreement between OnCall Technical Services and User regarding OnCall Technical Services collection and use of information from User and supersedes any prior representations, statements, proposals, negotiations, discussions, understandings, or agreements regarding the same subject matter. User acknowledges that it has not been induced to agree to the terms of this Privacy Policy by any representations or statements, oral or written, not expressly contained in this Privacy Policy.
